Terms of use

These are the terms between you and Naturally Creative for using Fair Go. We’ve kept them short and in plain English. Using the app means you accept them.

Fair Go is not medical advice

This is the important one. Fair Go counts kilojoules and keeps a record of what you ate and what you lifted. It is a general wellbeing tool, not a medical device, and nothing in it is medical, dietary or clinical advice. Energy figures are estimates drawn from food composition databases and from what you tell it; real food varies.

Talk to a doctor or an accredited practising dietitian before you change how you eat or train, especially if you are pregnant or breastfeeding, under 18, managing diabetes, heart, kidney or liver conditions, taking medication that interacts with food, or have a history of disordered eating. Your account

You sign in with Apple, so there is no Fair Go password to lose. You’re responsible for what happens under your account and for keeping your Apple ID secure. Fair Go is for people 16 and over. One person, one account.

Your content

Your logs, recipes, workouts and photos are yours. You keep every right in them. You give us only the permission we need to run the app for you: to store your content, show it back to you on your devices, and — only where you deliberately tap share — show it to the crew you chose. We do not use your content to train any model, and we do not publish it.

If you share a food by scanning a barcode and confirming the label, you agree that food can stay in the shared database for other people to use. It carries no connection to you.

Don’t use Fair Go to store or share anything unlawful, anything that isn’t yours to share, or anything abusive. We can remove shared content that breaks that, and close an account that keeps doing it.

Connecting an assistant

You can connect an assistant such as Claude or ChatGPT to your own data. If you do, you are choosing to let that service read and write on your behalf, under that service’s own terms and privacy policy, and we’re not responsible for what it does with what it reads. You can cut it off in the app at any time, and you should if you no longer trust it.

What you pay

Fair Go is in testing and free while it is. If paid features arrive, the price and what they include will be shown clearly before you buy anything, and any purchase goes through Apple under Apple’s terms, including Apple’s refund process.

The app itself

We’ll do our best to keep Fair Go running and accurate, but it’s provided as it is. We can change, pause or stop features, and we’ll give reasonable notice before removing something you rely on. Third-party data — the Australian Food Composition Database, AUSNUT 2023, Open Food Facts — is used under its own licences and we don’t warrant that every figure in it is right for the exact food in front of you.

Where we stand if something goes wrong

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law; you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.

Beyond those rights, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to resupplying the app or the amount you have paid us for it in the previous twelve months, whichever is greater.

Apple

Fair Go is downloaded through the App Store. Apple is not a party to these terms and has no obligation to provide support for the app. Where these terms are less protective of you than Apple’s Licensed Application End User Licence Agreement, that agreement applies instead.

Ending it

You can stop using Fair Go and delete your account at any time from inside the app, from You → Your data. We can close an account that breaks these terms, and we’ll tell you why unless the law stops us.

The fine print

These terms are governed by the law of New South Wales, Australia, and the courts there have jurisdiction — without taking away any right you have to bring a matter in a court where you live. If a part of these terms turns out to be unenforceable, the rest still stands. We may update these terms; if a change matters, the app will tell you before it takes effect.
